Welcome to Idntfy! These Terms of Use (“Terms”) govern your access to and use of our chat-and-scan services, available both on third-party stores via our embedded widget and directly at idntfy.me (the “Service”). By using the Service—whether anonymously or by creating an account—you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By clicking “I agree,” using our widget on a merchant site, or accessing idntfy.me, you confirm that you accept and will comply with these Terms. We reserve the right to refuse service to anyone for any reason at any time.

2. Scope of Service

Idntfy provides:

• Saved Profiles: Your personal fit measurements and style preferences.
• Personalized Style Advice: AI-driven recommendations via chat.
• Body Scans & Sizing: Performed through our integrated third-party scanning provider.
• Virtual Try-On: 3D garment previews via our third-party service.

General, non-personalized style advice is available anonymously; all other features require you to register for an Idntfy account and log in at idntfy.me.

3. Account Registration

To access saved profiles and personalized features, you must register for an Idntfy account with a valid email address and password. You are responsible for safeguarding your credentials and for all activity under your account.

4. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service solely for your personal, non-commercial shopping and styling purposes.

5. Prohibited Conduct

You agree not to:

• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Scrape, harvest, or mine any data from the Service.
• Impersonate any person or misrepresent your affiliation.
• Transmit spam, unsolicited messages, or bulk communications.
• Use the Service for any illegal, harmful, or fraudulent purpose.
• Interfere with or disrupt the integrity or performance of the Service.

We reserve the right to investigate and take appropriate action against anyone who violates these prohibitions.

6. Accuracy & Safety Disclaimers

The Service’s body scans, sizing recommendations, virtual try-ons, and chat advice are AI-generated and may be inaccurate. They are for informational and entertainment purposes only and must not be relied upon for medical, safety-critical, or any other serious decisions. Idntfy disclaims all warranties as to the accuracy, completeness, or fitness of the Service for any particular purpose.

7. Third-Party Content & Links

The Service may display or link to products and pages hosted by third-party merchants. We do not control and are not responsible for the content, privacy practices, or policies of any third party. Your interactions with such merchants are solely between you and them.

8. Termination & Suspension

We may suspend or terminate your access to the Service at our sole discretion, without notice or liability, for any reason, including if you breach these Terms.

9. Modifications to the Service

We may change, suspend, or discontinue any aspect of the Service at any time, with or without notice. We may also impose limits on certain features or restrict your access to parts or all of the Service without liability.

10. Fees & Charges

The Service is currently offered free of charge to end users. We may introduce fees in the future; any such changes will be made by publishing updated Terms or a separate pricing agreement.

11. Privacy

Your use of the Service is subject to our separate Privacy Policy, which explains how we collect, use, disclose, and safeguard your information.

12. Intellectual Property

All intellectual property rights in the Service and its content—including software, designs, graphics, text, and AI-generated recommendations—are owned by Idntfy or its licensors. You gain no rights to use Idntfy’s trademarks, trade dress, or logos.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IDNTFY AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

14. Indemnification

You agree to indemnify, defend, and hold harmless Idntfy and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your breach of these Terms or your use of the Service.

15. Warranty Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

16. Governing Law

These Terms and any dispute arising out of or relating to them shall be governed by the laws of Norway, without regard to conflict-of-law principles.

17. Dispute Resolution

Any dispute, claim, or controversy arising under or relating to these Terms must first be submitted to mediation in Oslo, Norway. If mediation fails to resolve the dispute within 60 days, either party may commence binding arbitration under the Norwegian Arbitration Act. Notwithstanding the foregoing, you may bring individual claims in small-claims court.

18. Notice of Changes

We may update these Terms from time to time. We will notify you of material changes by (a) emailing the address on file at least 30 days before they take effect and (b) posting a banner in your user profile on idntfy.me. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
